Abstract

Pedoman operasional use of force dalam keimigrasian Indonesia masih kabur. Kondisi ini membuka celah akuntabilitas, menaikkan risiko pelanggaran HAM, mengganggu efektivitas pengawasan. Kajian ini merumuskan kerangka operasional yang sah, perlu, proporsional melalui perbandingan terarah dengan praktik U.S. Immigration and Customs Enforcement (ICE). Metode yang dipakai ialah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, komparatif. Temuan pokok: pijakan struktural tersedia pada UU 6/2011 jo. UU 63/2024, namun rincian teknis belum memadai. Use-of-force continuum belum terkodifikasi; larangan teknik berisiko tinggi belum tegas; dokumentasi dan rekaman audiovisual belum wajib; sertifikasi tahunan belum mengikat. Rekomendasi berfokus pada Permenkumham “Pedoman Penggunaan Kekuatan”, SOP seragam untuk TPI, Rudenim, operasi lapangan, registri nasional insiden, indikator kinerja terukur, pelatihan berbasis skenario. Pendekatan bertahap menjaga kelayakan implementasi sekaligus memperkuat budaya akuntabilitas.
